Terms of Service

Fern Path helps parents and special education advocates understand IEPs, write letters to schools and prepare for meetings. These terms are the agreement between you and Griffin App, Corp ("Fern Path", "we", "us"), which runs it. By creating an account or using Fern Path, you agree to them. Our Privacy Policy explains how we handle your information and is part of this agreement.

The short version

  • Fern Path is a tool for preparing, not a lawyer. Nothing in it is legal advice.
  • AI can get things wrong. Check what it writes before you rely on it or send it.
  • Your documents and records stay yours. We use them only to run Fern Path for you.
  • Parents pay $19 a month or $149 a year, can cancel anytime, and can get a full refund within 30 days of paying. Advocates and organizations use Fern Path free.
  • Only add a child's records if you're their parent or guardian, or have the family's permission.

Who can use Fern Path

You must be at least 18 years old and able to enter a contract. Fern Path is for parents and guardians, and for the advocates and advocacy organizations who work with families. It isn't meant for children to use.

If you sign up for an organization, you agree to these terms for it, and you confirm you're allowed to.

Your account

  • Give us accurate information, and keep it up to date.
  • Keep your password and sign-in methods secure. You're responsible for what happens in your account.
  • Tell us right away at hello@fernpath.app if you think someone else has used it.
  • One person per account. Invite others to a child's team instead of sharing a sign-in.

Fern Path isn't legal advice

Fern Path explains special education rules, reviews IEPs, suggests requests, calculates deadlines and drafts letters. That's general information to help you prepare. It isn't legal advice, and using Fern Path doesn't make us your lawyer or your advocate. We aren't a law firm. Laws, deadlines and district practices vary and change, and only you know your child and your situation. For advice about your case, talk to a special education attorney or a qualified advocate.

Advocates who use Fern Path are independent. They don't work for us, and we don't supervise, endorse or answer for the advice or services they give you. Any arrangement you make with an advocate, including what you pay them, is between you and them.

AI features

Some features use AI to read documents, answer questions, review IEPs and write letters and agendas. AI can misread a document, leave something out, or state something wrong with confidence. Before you rely on anything Fern Path produces, or send it to a school, read it and check it against the records. You decide what to send and to whom; Fern Path never sends anything to a school for you.

Your content

"Your content" is what you put into Fern Path: documents you upload, records you enter, notes and messages, and the letters and other results Fern Path makes for you.

  • It's yours. You keep all your rights in it.
  • What you let us do. You give us permission to store, copy, process and display your content, and to send it to the service providers named in our Privacy Policy, only so we can run Fern Path for you and the people you share it with. That permission ends when the content is deleted, apart from backup copies, which are removed as they cycle out, and copies our AI provider keeps for a short time as our Privacy Policy explains. If you close your account, what you added to a child who's shared with others stays with their team, as our Privacy Policy explains.
  • We don't train AI on it. Your content isn't used to train AI models, ours or our AI provider's.
  • You have the right to share it. Only upload records you're entitled to have and share. If you're an advocate, you must have the family's permission before adding a child's records, and you're responsible for keeping any promises of confidentiality you've made to them.

Sharing with a child's team

When you invite someone to a child's team, they can see and edit that child's records. Invite only people you trust with them. Who can remove whom depends on their role on the team, and anyone can leave a team that has someone else on it. We aren't responsible for what team members do with what you share with them.

Using Fern Path fairly

Please don't:

  • upload records you have no right to, or records about a child without permission;
  • use Fern Path to harass, threaten or deceive anyone, or to break the law;
  • try to get into accounts, children's records or parts of Fern Path that aren't yours, or test, probe or get around its security;
  • overload Fern Path, scrape it, or use bots to reach it, except as its features offer;
  • copy, resell or rebrand Fern Path, or use it to build a competing service;
  • upload viruses or anything else meant to cause harm.

Membership and billing

  • Prices. Parents can use some of Fern Path free. Membership opens the rest, for $19 a month or $149 a year, plus any sales tax. When a parent on a child's team is a member, everyone on that team gets the membership features for that child. Advocates and organizations use Fern Path free.
  • Renewal. Membership renews automatically at the end of each month or year, and the card on file is charged the then-current price until you cancel. Payments are handled by Stripe; we never see or store your full card number.
  • Cancelling. Cancel anytime from the Billing page. Your membership then stays active until the end of the period you've paid for, and you won't be charged again.
  • 30-day money-back guarantee. If Fern Path isn't right for you, email hello@fernpath.app within 30 days of a membership payment for a full refund of it. A refund ends membership straight away. Otherwise payments aren't refundable, except where the law requires.
  • Price changes. We'll tell you at least 30 days before a new price applies to you, so you can cancel first.

Our service

We're always improving Fern Path, so features may change, and some may be added or removed. We'll give you notice before removing something important you pay for. We work to keep Fern Path available and your records safe, but it may sometimes be down for maintenance or because of problems outside our control. Keep your own copies of important records; Fern Path isn't a substitute for them.

Fern Path's software, design, name and logo belong to us. These terms let you use Fern Path; they don't give you any other rights in it. If you send us feedback or ideas, we may use them without owing you anything.

Some features connect to other services, such as Google Drive when you import a file, or Google and Apple for signing in. Their own terms apply to your use of them.

Closing your account

You can stop using Fern Path at any time. Cancel any membership from the Billing page, and to delete your account, follow the steps in our Privacy Policy.

We may suspend or close an account that breaks these terms, puts children's records or other people at risk, or that the law requires us to. Unless that would be unsafe or unlawful, we'll tell you why and give you a chance to get copies of your records first. If we close your account without a good reason under these terms, we'll refund the unused part of any membership you've paid for.

If we ever shut Fern Path down, we'll give you at least 30 days' notice to get copies of your records, and refund the unused part of any membership.

Disclaimers

We work hard to make Fern Path accurate and useful, but we provide it "as is" and "as available". To the fullest extent the law allows, we make no promises beyond those in these terms, including that Fern Path will be error-free, uninterrupted, or fit for a particular purpose, or that it will lead to any particular result at an IEP meeting or with a school.

Limits on our liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of Fern Path. Our total liability for any claim about Fern Path is limited to the greater of what you paid us in the 12 months before the claim, or $100.

Some places don't allow these limits, so they may not all apply to you. Nothing in these terms limits liability for our fraud, gross negligence or willful misconduct, or any rights you have that the law doesn't let a contract take away.

If you use Fern Path for your work

If you're an advocate or an organization using Fern Path for your work, you agree to defend us and cover our reasonable costs if a family or anyone else makes a claim against us because of the services you gave them, content you added without the right to, or your breaking these terms.

Disputes

If something goes wrong, please email us first at hello@fernpath.app; most problems can be sorted out quickly that way. If we can't resolve it within 60 days, either of us can take it to court.

California law governs these terms, without regard to its conflict-of-law rules. Claims go to the state or federal courts in California, and we both agree to those courts' jurisdiction. Either of us can also bring a claim in small claims court where you live, if it qualifies. If you live outside California, this doesn't take away any protections the consumer laws where you live give you.

Changes to these terms

We may update these terms as Fern Path grows. When we do, we'll change the date at the top. For important changes, we'll tell you by email or in Fern Path at least 30 days before they take effect. If you keep using Fern Path after that, you're agreeing to the new terms; if you don't agree, you can cancel and close your account before then.

The rest of the fine print

  • These terms and the Privacy Policy are the whole agreement between us about Fern Path.
  • If a court finds part of these terms unenforceable, the rest still applies.
  • If we don't enforce a term right away, we can still enforce it later.
  • You can't transfer your account or these terms to someone else without our agreement. We can transfer them if Fern Path is sold or merged, under these terms' promises.
  • Sections that by their nature should last, such as content ownership, disclaimers, limits on liability and disputes, still apply after your account closes.
